The MOE recommended not to be punished twice for the same violation, prevention should be the main measure of exposure, reports a press-service of Open government.

«The Ministry recommended to implement a risk-based approach in other areas of supervision and increase the role of preventive measures, and administrative responsibility must cease to be a primary measure to combat violations. The MOE, in particular, should not be punished twice for the same violation, and a warning should be the main measure of impact», — stated in the message.

It is noted that such recommendations are contained in the resolution on the results of the national forum of Open government, the Ministry, and entrepreneurial platform of the party «United Russia» on the reform of the national audit office and public discussion of enforcement practices of the Supervisory authorities of the Ministry of emergency situations. This document was signed by Minister for Open government Mikhail Abyzov and Minister of emergency situations Vladimir Puchkov.

According to the report, the practice of issuing cautions, warnings, or oral observations in the resolution proposed to be recognised as an effective instrument of state punishment of offenders, and the practice of prosecution for the same violation without sufficient evidence should be excluded.

«The imposition of cautions, warnings or oral comments must be identified as key interventions. In addition, MOE was recommended to carry out explanatory work with representatives of small and medium-sized businesses and give a warning or oral warning in case of violations committed for the first time, and to continue work on the development of the Institute advising the business community on the rules of integrated security», — added in the release.
