The company 2 the Nord Stream AG does not consider it necessary to conclude between the EU and Russia agreement on the legal framework of the project, said the official representative of the operator Sebastian SaaS.

«You heard about the recent ideas of an international agreement between the EU and Russia on the legal framework, but we do not consider them necessary,» said SaaS participants of the business Breakfast organized by Nord Stream AG 2 in Brussels.

According to him, in implementation of the project interested companies from 17 countries, has already attracted more than four billion euros of investment.

The dispute of the parties

On the «Nord stream — 2» is not subject to the rules of the EU internal market, the so-called «third energy package», as the pipeline will be laid not on the ground part of the European Union and on the seabed.

In the opinion of the European Commission, the regulation of the internal gas market of the EU «is fully applicable to any terrestrial infrastructure, as for offshore pipelines, they cannot be built and operated solely under the legislation of a third country or in a legal vacuum.»

However, in 2 of the Nord Stream AG had previously stated that the pipeline is not built in a legal vacuum and only according to the rules of one country, and takes into account the legislation, including in the field of the environment, other countries. In addition, the new pipeline should pass parallel to the existing Nord stream, formerly of compliance with multiple international regulations.

Since the granting of permission for laying pipelines is the responsibility of the member countries of the EU, the European Commission considers it necessary «to establish a special legal regime for the offshore section of the pipeline: such a regime should include some fundamental principles derived from EU legislation in the field of energy».

Among these principles, the European Commission calls «proper transparency of the operation of the pipeline, the establishment of non-discriminatory tariffs (for gas pumping. — Approx. ed.), the appropriate level of access (to opportunity to pump gas. — Approx. ed.) of third parties, as well as the level of separation activities for the sale and transport».

The project «Northern stream — 2» involves the construction of two pipelines with a total capacity of 55 billion cubic meters of gas off the coast of Russia through the Baltic sea to Germany. The new pipeline is planned to be build next to the «Nord stream».
