The government proposes to give the competent Executive authority of Moscow right through the court compelling the owner of the property included in the renovation programme, to participate in case agreement on the transfer of ownership is concluded, according to the text of the amendments of the Cabinet to the draft law on peculiarities of legal regulation in the field of renovation of housing, published on the official website.

«If the contract on transfer of ownership of a dwelling located in an apartment building, included in the decision about the renovation, is not enclosed, the authorized body of Executive power of the city of Moscow has the right to address in court with requirement about compulsion to conclude the contract… on the registration of property rights of the owner of premises located in an apartment building, included in the decision on renovation, with equivalent residential premises», — said in the text of the amendments.

According to the amendments, in such statement of claim must specify the address of total living space, number of rooms provide an equivalent dwelling. All consideration provided for in this part of the requirements is carried out in the framework of one judicial proceedings.

The mayor of Moscow Sergey Sobyanin said that if Muscovites consider that resettlement they were provided with the uneven or unequal housing, they should have the right to challenge it in court, as the fact of relocation. As previously stated the authorities in Moscow, the renovation programme will include only those houses where the inhabitants of two thirds of the apartments will vote for the renovation. In forming the list takes into account technical condition of the house and the opinion of its inhabitants in a preliminary survey.

According to Sobyanin, the implementation of the rights of Muscovites will not be infringed and they have received new apartments will be between 25-35% of its market value more expensive than housing that is demolished. The mayor also noted that the building will be decommissioned only after signing all tenants of the acts of reception and transmission apartments. The law on the renovation of housing Sobyanin proposed to guarantee the issuance of the tenants a new apartment in the same area and with the finish, to provide the rule of replacement of the mortgage with the same conditions and to secure assistance in moving those in need. It also proposes to provide the right of owners of non-privatized apartments to choose between obtaining a new home ownership or social employment.

The mayor also signed a city law on additional guarantees of the housing rights and property for renovation in Moscow. According to the document, the Muscovites guaranteed equivalent housing or compensation for the vacated premises. In addition, the owners of apartments on social hiring will provide housing sinarmas. The elderly, veterans, the disabled and large families will be provided assistance in moving. Owners of non-residential premises in the building to be demolished will provide the equivalent of the room or the money will be paid. According to the mayor, new homes will be built in the year following the adoption of the law and approval of a programme of renovation, with the project of new apartments tenants will be able to see in advance.
