The state Duma adopted on Friday in the first reading the draft laws providing punishment up to imprisonment for the attack on medical workers, obstructing their activities and blocking ambulances.

The package of draft laws on the protection of medical workers and patients was developed by the Vice speaker of the state Duma Irina Yarovaya and Chairman of the Duma Committee on health Dmitry Morozov, the Minister of health Veronika Skvortsova. Earlier initiatives were supported by the Supreme court of the Russian Federation and the government of the Russian Federation and entered on April 3 in the Duma. The bills establish two types of liability: criminal and administrative for the mere fact of obstructing the lawful activities of a physician by withholding, threats and him creating obstacles for access to the patient.

The criminal code is proposed to add a new article, which for obstructing the legitimate activities of a health worker in the provision of medical care by withholding, threats, obstructing access to the patient, if it entailed by negligence the infliction of medium-gravity harm to the health of the patient shall be punished by a fine in the amount up to 40 thousand rubles, compulsory work up to 360 hours, correctional work for up to one years or arrest to four months.

If this act entailed by negligence the death of the patient or causing of heavy harm to his health, the sanctions can be strengthened. A convict can be sentenced to compulsory works for a term up to four years with a possible deprivation of the right to occupy certain positions for up to three years or deprivation of liberty for a term up to four years with a possible deprivation of the right to occupy certain positions for up to three years.

At the same time it introduces criminal responsibility for infliction of harm (imprisonment for up to two years) and death threats against persons in the performance of official duties (forced labor up to five years or deprivation of liberty for up to five years).

The second bill in this package provides for amendments to the Code of administrative offences of the Russian Federation. For obstructing the legitimate activities of health care provider for assistance, if these actions do not contain signs of penal act, shall be punished of a fine from four thousand to five thousand rubles or arrest for up to 15 days.

For failure to provide the benefits of moving ambulances with flashing beacon blue and a special sound signal that caused the failure or the provision of emergency medical care with time and if these actions do not contain signs of penal act, it is proposed to set the penalty of 30 thousand rubles with deprivation of the right of management by vehicles for the term from six months to two years
