The Russian state Duma on Friday will consider in the first reading a bill banning the use of technology to access blocked Internet sites with illegal content.

The project was made in early June by deputies of three factions — Maxim Kudryavtsev (United Russia), Nikolay Rijekom («Fair Russia») and Alexander Yushchenko (CPRF).

As the authors of the bill, is the statutory prohibition to use technology to access blocked in Russia, the information resources, but access to some sites, allowing to «bypass the lock» is restricted on the basis of decisions of the Russian courts.

The bill prohibits the use of information systems and programs to gain access to Internet resources access to which in Russia is limited.

However, it is proposed to provide access to these networks and programs to the information resources of Roskomnadzor, containing data on sites to which access is restricted.

«We offer the present project the mechanism of restriction of access to information resources on the basis of decisions of Roskomnadzor introduced with the aim of preventing harmful consequences from the use of «media bypass» (possible adverse consequences include the spread of forbidden information, extremist material violation of the exclusive rights, etc.) and does not exclude the possibility of appeal against such decisions in court», — stated in the explanatory Memorandum.

The document also introduces a ban for the operators of the search engines on the issuance of references to the territory of Russia on the lock resources. For the operators of search engines, this ban is also proposed to provide them with access to the registry of banned sites Roskomnadzor.

For failure to fulfill these requirements in the accompanying bill for Telecom operators will be subject to administrative liability. It is proposed to establish a fine for citizens in 5 thousand roubles; for officials — 50 thousand rubles and for legal entities — from 500 thousand to 700 thousand rubles.

Exception for legal entities

On Thursday profiled the state Duma Committee on information policy recommended the adoption of this bill.

«The bill has a soft adjustment between users, anonymizers, and Roskomnadzor. The use of anonymizers will not be restricted if their owners will comply with the provisions of the law. The bill does not impose new prohibitions, as illegal content is banned», — said one of the bill’s authors, state Duma Deputy Maksim Kudryavtsev, whose words are quoted by the press service of the Duma Committee on information policy.

The head of the Duma Committee on information policy Leonid Levin also previously stressed that the bill anonymizers are directed not to introduce new restrictions for law-abiding citizens, we are talking only about the ban on the use of services to access illegal content.

In addition, it was noticed that an exception has been made for the encryption of networks of legal entities that use these services to the corporate goals.

Cancellation of registry of bloggers

In addition, the bill envisages the abolition of the registry of bloggers.

August 1, 2014 in Russia came into force a law under which websites with more than 3 thousand users per day should be included in the appropriate register maintained by Roskomnadzor.

According to Levin, the abolition of the registry of bloggers — a timely measure, «as in connection with the development of technology it has lost its meaning».
