Alexei Navalny in connection with the record currently does not have the right to be elected, said Friday the Russian Central election Commission.

«According to available information, 8 February 2017 A. A. Navalny convicted under part 3 of article 33, part 4 of article 160 of the Criminal code of the Russian Federation for five years of imprisonment with a fine of 500 thousand rubles, while the penalty imposed is decided to consider conditional with a trial period of 1 year and 5 months (a sentence in force). Therefore, at the present time A. A. Navalny does not have a passive electoral right», — reads the statement of the CEC, published Friday on the Agency’s website.

The CEC also recalled the position of the constitutional court, according to which «the restriction of the passive right to vote was recognized corresponding to the Constitution of the Russian Federation, but noted that such a limitation should not be indefinite».

Subsequently the law was amended, which established the terms of this restriction, specified in the CEC. This limitation is ten years from the date of withdrawal or the maturity of convictions for serious crimes and 15 years for the most serious crimes.

The head of the CEC of Russia, Ella Pamfilova said earlier that Alexei Navalny has no chance to be registered as a candidate in the presidential elections due to his criminal record serious article. She believes that this is understood and the opposition. In addition, the CEC before that also said that Navalny could not participate in elections as candidates, and to gain a passive electoral right, he needs to go to court, appeal against sentence, there is no other way.

The Kirov regional court has previously confirmed a five-year suspended sentence Navalny on charges of embezzlement of more than 16 million rubles of the company «Kirovles». The first sentence, too, five years probation, was cancelled by the Supreme court of Russia after the Strasbourg court found violations of the rights of defendants at the trial.
