Obolonskiy district court of Kyiv after four days of preliminary sessions will begin on Monday the consideration of the merits of the criminal case of treason against former President of Ukraine Viktor Yanukovych.

Yanukovych’s participation in the meeting is not expected as earlier, the Kyiv court refused to send to Russia a request for international legal assistance in the organization of his participation in the video conference, the Rostov regional court.

In case of absence of the former President to the meeting, the court will be raised about the possibility of the case in correspondence mode.

The first case in court

The Prosecutor General’s office of Ukraine finished investigation of criminal case of treason on 30 January, after which its materials were transferred to the study of lawyers.

A case of treason is first transferred to the court from a list of cases that were opened against Yanukovych in Ukraine after the coup in 2014. In addition, the former Ukrainian leader is involved in cases of deaths during riots in downtown Kiev in 2014, the acquisition of forest lands, «Suholuche», land and residence «Mezhyhiria» near Kiev, as well as cases of theft of state funds in the implementation of one of the projects of the company «Ukrtelecom» is the largest operator of fixed telephony.

According to the Prosecutor General of Ukraine Yuriy Lutsenko on charges of treason Yanukovich accused that, «being on the territory of the Russian Federation in March 2014, signed a letter addressed to the President of the Russian Federation and invited him «to enter Ukraine and the occupation troops».

Previously, the former President of Ukraine denied the accusations, saying that he had sent letters to the authorities of the Russian Federation with such appeals. Russian authorities also said that they had not received a letter with similar content.

Kiev has repeatedly accused Moscow of meddling in Ukraine’s Affairs. Russia denies it and calls such accusations unacceptable. Moscow has repeatedly stated that it is not a party to domestic conflict, uninvolved in the events in Donbass and is interested in Ukraine overcame political and economic crisis.

The prosecution has already stated that it intends to ask the court punishment for Yanukovych — life imprisonment. According to the procedural head in the case of the Prosecutor Viktor Kravchenko, due to the fact that the former Ukrainian leader did not admit his guilt.

President of Ukraine Petro Poroshenko has demanded a transparent judicial process in this case. According to him, the court must be in public mode, and the lawyers of Yanukovych should be provided the opportunity to defend my client’s rights.

Trial in absentia

The investigation of treason was held on the procedure of conviction, which was introduced in Ukraine in 2014, specially to prosecute Yanukovych and his entourage. The new procedure allows to investigate criminal cases and to judge in absentia suspected of committing serious crimes if they are hiding from the investigation abroad.

During the preliminary meeting that Yanukovych did not appear, the court gave him the opportunity to participate in the process via videoconference from Russia. However, the protection requires that the Prosecutor General’s office of Ukraine sent to the Ministry of justice of the Russian Federation a request for international legal assistance, in which you can set the video. The Ukrainian side refuses to make such a request, the Prosecutor stated that it was unnecessary.

The defence submits that the Prosecutor General of the country violated the right of the accused to access to justice, refusing to direct an inquiry to Russia. In this regard, lawyers said that preparing an appeal to the European court of human rights.

Protection of Yanukovych intends to continue to ensure the participation of the former President in the meeting in a videoconference mode of the Rostov regional court. According to the lawyers, Yanukovych is not against personal participation in the meeting, however, cannot do this because in Ukraine it is threatened.

During the preliminary hearing, the court also emphasized that is ready to provide Yanukovych protection, in case of receipt of such petition.

Earlier, the court summons posted on his website, Yanukovych called for 10 sessions, which will consider his case on the merits. They are scheduled for 26 and 29 June, 6, 12, and 13, Jul, 3, 10, 17, 23 and 31 August. In case of absence of the former President, the court will consider the proceedings in absentia.
