The situation with information disclosure on the implementation of departmental plans, anti-corruption has improved and is satisfactory, but the approach to their implementation remains formal, leads the open government of Russia the results of quarterly monitoring of anti-corruption Expert Council under the government of the Russian Federation for the second quarter of 2017.

The members of the Council are inclined to believe that the legal regulation of the procedure for the receipt of gifts by civil servants need to improve, experts suggest to do a model code of ethics binding, noting that the strengthening and the addition of this document may move the «ethical» issue from the dead point.

According to the presidential decree approving the National anti-corruption plan for 2016-2017, the heads of Federal bodies of state power had until may 15, 2016 to amend the departmental plans of counteraction of corruption the changes directed on achievement of concrete results in the prevention of corruption, noted in a press-service of Open government.

The Prime Minister instructed the Ministry of labor and the Minister for Open government Mikhail Abyzov jointly with the Expert Council under the government of the Russian Federation on a quarterly basis, beginning October 1, 2016, to ensure control over the implementation of measures stipulated in these plans, the report said.

The report notes that there are positive changes in the work of Federal agencies with anti-corruption plans. «But the basic problem remains – the approach to their preparation and performance in most cases is still of a formal nature», — the press service quoted the words of the head of the working group on anti-corruption Expert Council under the government of Kirill Kabanov.

Abyzov notes that in past years, the quality of implementation of the National anti-corruption plan was often left much to be desired, there were a lot of comments to departmental corruption plans.

«Many of them were formal and did not take into account sectoral specificities. In order to avoid repetition of such practices, it is important to increase personal involvement and personal responsibility of heads of ministries and departments for compliance with all items of this fundamental document», — the press service quoted Minister of the Russian Federation on issues of Open government.

Gifts to officials

In the message the press-services is noted that the expert Council also reviewed how the state bodies comply with the requirements of legislation restricting the receipt of gifts by officials. According to the study, normative legal acts, regulating the procedure of the receipt by public officials of gifts, adopted in 47 of the 53 ministries and departments.

«More than half of state agencies posted on the websites of the special form of notification about receiving a gift. While the forms of the transmission of gifts is available on the websites of only nine authorities», — quotes the press-service of Open government data monitoring.

In the opinion of the expert Council members, the implementing ministries and agencies of regulations about the restrictions on the receipt of gifts is considered satisfactory, but departmental activities and documents can be traced to incomplete understanding of the subject of regulation, there is no uniformity of enforcement. In this regard, the experts noted the need to improve the legal regulation of receipt of gifts by civil servants.

Kabanov noted that officials often bypass existing restrictions, accepting a gift of alcohol and food. «This situation should be broken. My opinion – not to create chaos, we need to introduce a complete ban on the receipt of gifts by civil servants, with the exception of plastic pens and calendars, and non-compliance to be regarded as a bribe», — the press service quoted the words of the head of the working group on anti-corruption Expert Council under the government.

Improving ethical framework

The expert Council proposes to consider a number of standard designs of unethical behavior prior to Commission of corruption offences.

Directly the ethical issues model code of ethics and official conduct of civil servants of the Russian Federation and municipal employees, approved the decision of the Presidium of the presidential Council of the Russian Federation on corruption counteraction from December 23, 2010, stated in the message of Open government.

«Now the provisions of this document are Advisory in nature, violation of its provisions does not entail any legal responsibility. We need to ensure that the code of ethics became the basis for decisions to become binding. Amplification and addition of the document could move the «ethical» issue from the dead», — quotes the press-service of the word Kabanov.
