The UN special Rapporteur on the question of negative effects of unilateral coercive measures on the enjoyment of human rights Idriss jazaïry proposes to create under the auspices of the UN security Council, the special compensation Committee, which will examine the claims of the victims of unilateral sanctions.

«The special Rapporteur believes that the time has come for the international community reaffirmed the right of all persons the enjoyment of human rights which has been undermined by unilateral coercive measures, to an effective remedy, including appropriate and actual financial compensation,» the report says jazaïry, presented Wednesday at the 36th session of the UN Council on human rights in Geneva.

It is assumed that such a Commission would be established under the auspices of the UN security Council, and one of the possible sources of financing will be deposits of States that impose sanctions.

At the same time, to prevent the adverse effects of unilateral sanctions on human rights States should completely abandon the use of such unilateral coercive measures in accordance with international law, said the speaker.

«The fact that States are increasingly resorting to unilateral coercive measures, demonstrates the need for confirmation of certain fundamental principles of international law», — stated in the document submitted Jazairi at the UNHRC.

The special Rapporteur also reiterated the proposal to establish a UN «registry of unilateral coercive measures that could have an impact on human rights». With this initiative, he has already performed in the course of 70th and 71st General Assembly of the United Nations, as well as in previous reports to the UNHRC.

Jazairi offers to create such a registry by January 1, 2018. The member countries of the UN will have in the period until 30 April to submit information about the sanctions that were enacted, or act against them. This procedure will be conducted annually, and the registry will be open for public discussion.

The special Rapporteur considers that such a mechanism can be agreed, established and enacted in the very near future.
