The Moscow arbitration court on Monday will hold preliminary hearings on the case of Siemens to the structures of «Rostec», which the German company requires to recognize the illegal deal to supply turbines for Siemens under construction in the Crimea power plants.

Defendants in the lawsuit stated included in «rostec», JSC «VO «Technopromexport» (JSC TPE) and JSC «VO «Technopromexport» (TPE), as well as the turbine manufacturer OOO «Siemens gas turbine technology» (STGT, 65% owned by Siemens, 35% — «Power machines»).

The German company requires to invalidate the transaction consisted of two parts — the agreement between the STGT and JSC TPE from 10 March 2015 and the contract between JSC TPE and TPE from October 16, 2015. Also requires the plaintiff to apply the consequences of invalidity of transactions, namely to oblige, OOO TPE return of the four turbine manufacturer — the Russian subsidiary of Siemens.

Siemens has previously stated that the Crimea was illegally put four designed for a project in Taman gas turbines. OJSC Tekhnopromexport, which is 2016 in the bankruptcy procedure, at one time signed a contract for the purchase of four turbines of Siemens for a project in the Krasnodar region, which eventually was not implemented. The plaintiff requested the seizure of four turbines, as well as to establish a ban on the installation of these turbines in the Crimea. Siemens explained his request by the fact that in the event of a claim the dismantling of the turbines will result in a significant time and cost return them to the plaintiff, it can be difficult or impossible. In addition, the German company, as stated in the court ruling, said about the possibility of causing significant damage, since the installation of the controversial turbines and their subsequent operation will reduce their cost as the equipment is subjected to wear and would be considered secondhand. However, the court found that the plaintiff had not submitted evidence to support the possibility of causing significant damage, and the legal basis for the adoption of interim measures not found.
