The CPS has prepared a bill introducing criminal and the tightening of administrative responsibility for production, import and sale in Russia of adulterated food products, said Deputy head of the sanitary supervision of the Ministry Andrei Gorsky at the meeting in the state Duma.

«The CPS was prepared for introduction through the government two draft Federal law,» he said.

In order to strengthen measures against trafficking in counterfeit products first the bill amends the Code of administrative offences (CAO), the second – the criminal code (CC) and Criminal procedure code.

Administrative responsibility

The first bill concerns the administrative responsibility for manufacture and import on territory of the Russian Federation to implement, or sale of counterfeit food products. For such an offence it is proposed to introduce a fine for officials in the amount from 10 thousand to 15 thousand rubles, individual entrepreneurs – from 30 thousand to 50 thousand rubles, legal entities – from 50 thousand to 100 thousand rubles. While for individual entrepreneurs or legal entities possible confiscation of subjects of an administrative offense.

If such violations committed under nutrition in preschool and other educational organizations, medical organizations, health agencies, social service organizations and do not contain signs of penal act, the penalty will be higher. For officials it will be from 15 thousand to 30 thousand rubles, individual entrepreneurs – from 50 thousand to 100 thousand rubles, legal entities – from 100 thousand to 300 thousand rubles. And in this case, the subjects of the administrative offence may be confiscated.

With repeated offenses in these cases, the penalty for officials will make from 30 thousand to 50 thousand rubles, individual entrepreneurs – from 100 thousand to 200 thousand rubles, legal entities – from 300 thousand to 1 million rubles. While individual entrepreneurs and corporate entities of possible confiscation of subjects of an administrative offense.

Criminal liability

The second bill criminalizes the manufacture, import or realization in Russia of adulterated food products.

For such crimes on a large scale (more than 400 thousand rubles), with the exception of individual cases, the CPS proposes to impose a fine in the amount from 300 thousand to 800 thousand rubles or the salary or other income of the convicted person for a period up to six months. As a possible alternative to compulsory work for a term up to 200 hours, or correctional labor for a term up to one year.

In the case of committing such crime by a group of persons by prior conspiracy, an organized group or in especially large size (over 1 million) the fine will be from 500 thousand to 1 million rubles or the salary or other income of the convicted person for a period up to six months. Alternative — compulsory work for a term of up to 360 hours, or correctional labor for a term up to two years.

But if such acts occur under nutrition in preschool and other educational organizations, medical organizations, health institutions, institutions of social service, the penalty is proposed to establish in size from 1 million to 3 million rubles or the salary or other income of the convicted person for a period up to one year. Is fine possible compulsory work for a term of up to 480 hours, or correctional labor for a term up to two years.
