Podolsk city court of Moscow has collected 177 thousand rubles on the first claim affected by delays of flights of airline «VIM-Avia», reported RIA Novosti lawyer Alexei Mikhalchik.

The plaintiffs demanded compensation in the amount of 869 thousand rubles.

«The claim is satisfied partially,» said the lawyer.

«The court awarded moral damages of 50 thousand for each family member, 25 thousand rubles compensation for legal costs and approximately 2 thousand roubles of the penalty,» — said the lawyer.

He explained that in part claims for compensation under the Montreal Convention, the court refused. «In principle, we are pleased with the decision. We have studied the jurisprudence and there exacted much less per day of delay. But we have a special case — one of the family members is seriously ill,» said michalczyk.

The question of the appeal decision, he will decide after consultations with their principals.

The plaintiffs are parents with a child that a day spent at the airport. The situation was complicated by the fact that the mother suffers from serious illness and forced to take a rare and expensive medications. When they began to run, they panic and the next day they were sent home.

According to Michalczyk, the situation was «severe and traumatic», so they decided to go to court. The lawyer insisted on compensation of moral damage in the amount of 150 thousand rubles, and damage under the Montreal Convention, to which Russia joined, in the amount of 719 thousand rubles.

The situation with the flight «VIM-Avia» has escalated on 23 September because of debts. The total payables of the company is around 10 billion rubles.
