The airline said in court in the United Arab Emirates the petition in which asked court to leave without consideration the claim of relatives of passengers of the crashed in March 2016 in Rostov-na-Donu Boeing, told RIA Novosti lawyer Vsevolod Sazonov, representing the interests of the plaintiffs.

«The opposite party was asked to leave the claim without consideration because, according to them, it is to be considered by a Russian court,» said Sazonov.

Previously, he reported that a court in the UAE on 5 October was accepted to consideration the statement of claim in which each of several co-plaintiffs require compensation from the airline amounting to 10 million dollars for the bereaved relatives. Sazonov did not specify the exact number of victims who have United to filing a suit, citing attorney-client privilege.

According to the lawyer, the plaintiffs insist on consideration of the claim at the court of the UAE. «In the case of the Russian court and the claim we are faced with the need to bring the application for enforcement in the UAE that will is highly problematic, as a UAE court may refuse on formal grounds, for example, because of failure of public policy to court with the statement for recognition of a foreign decision,» said Sazonov.

He said that for a claim to state-owned companies, which is FlyDubai, the UAE laws, required to obtain the consent of the administration of the Emirate. According to Sazonov, the consent to the filing of a claim by relatives of the victims of the crash Rostov, whose interests it represents, from the administration of the Emirate of Dubai was received.

As reported by Sazonov, at the last sitting the court heard the objections of the plaintiffs against the abandonment of the claim without consideration and provided time for the defendant to prepare the opinion, in connection with which the hearing was postponed to 11 December.

The press service of FlyDubai informed RIA Novosti reported that the airline is committed to providing fair compensation to the families of all the dead passengers «in accordance with applicable law.» However, as specified in the airline, «due to the circumstances of a legal nature and commitments to confidentiality, discussion of litigation, claims and compensation occurs only with family members and their representatives».
