The opinion of one judge cannot change the decision of the constitutional court of the Russian Federation on restriction of participation in elections of persons having a criminal record, said Wednesday RIA Novosti in the press service of the COP.

Earlier, the judge of the constitutional court Konstantin aranovsky expressed disagreement with the ban on participation in elections of people on probation for serious or especially serious articles. He considered that the contested provisions could be checked for compliance with the Constitution of the Russian Federation in that measure in what they in 10 years limit the right of citizens to be elected after the withdrawal or repayment of their convictions, if the citizens of these was sentenced to imprisonment for a serious crime.

In a press-service of the COP recalled that the constitutionality of a law prohibiting to stand for election to all those who are sentenced to deprivation of liberty for committing grave and especially grave crimes, the COP established in 2013 and subsequently repeatedly reaffirmed this legal position in other solutions.

«These decisions are final and not subject to revision. However, the democratic system of constitutional justice is that a judge who disagrees with his colleagues, has the right to expound their point of view. This opinion shall be published together with the text of the decision of the constitutional court. But no more. The opinion of one judge, and the minority in reaching a decision, the COP can not change the fate of the document itself,» — said the press service of the COP.

They added that earlier to the previous acts of the constitutional court elaborated on this legal position, none of the judges in his dissenting opinion is not stated. Why the judge decided to speak out now, the press service of the constitutional court does not comment.
