The Council of bishops prescribed in the Statute of the ROC that the control center of the Ukrainian Orthodox Church of the Moscow Patriarchate in Kiev. In this case, the Patriarchate explained that the UOC remains a self-governing part of it.

«Adopted by the Council of bishops of the changes to the Charter are more technical in nature, since the position of the Ukrainian Orthodox Church was in the General head of self-governing churches, and in this regard created a number of inconveniences associated with the proper understanding of its provisions,» — said RIA Novosti the press Secretary of Patriarch Kirill, the priest of Alexander Volkov.

According to him, the situation on the Ukrainian Orthodox Church ruled in a separate Chapter, but it will not affect its status.

Special status

To emphasize the special status of the UOC Council of bishops asked Metropolitan of Kiev and all Ukraine Onufry.

«In recent years, intensified by some political forces that are attempting to discredit the Ukrainian Orthodox Church in the eyes of Ukrainian society, capitalizing on it as they claim «dependent» status. They ignore the special status of the Ukrainian Orthodox Church lies in the Determination of the Council of bishops of the Russian Orthodox Church in 1990, and thus refer to the current Statute of the Russian Orthodox Church,» he said.

According to the Metropolitan, to stress the special status of the UOC is necessary in order to avoid «further speculation aimed at undermining the authority of the Ukrainian Orthodox Church in the eyes of millions of Ukrainians.»

Changes in the Charter

In the current Charter, the status of the Ukrainian Orthodox Church spelled out in paragraph 18 of Chapter XI, entitled «a self-governing Church». As noted by Andrew, this item is «not fully displays the Definition of the Council of bishops of the Russian Orthodox Church in 1990 on granting the Ukrainian Orthodox Church independence and autonomy in its management». The Metropolitan of Kiev suggested to create a separate Chapter called «Ukrainian Orthodox Church». The proposal of the Metropolitan was unanimously adopted.

The Charter also made a clarification, according to which the General ecclesiastical court with jurisdiction throughout the Russian Church, except for the UOC. From that moment on he will be referred to as «the Highest Church court.» Now the decisions on the cases of clergy of the UOC who have violated Church canons, will take the leadership of the Ukrainian Orthodox Church, not the Patriarch of Moscow, as before. In this case the final appellate court remains the Council of bishops of the Russian Orthodox Church.

To prevent anti-clerical laws in Ukraine

According to lead researcher and Director of the Center for the study of problems of religion and society Institute of Europe RAS Roman Lunkin, the amendments will help to avoid making the anti-Catholic bills in Parliament.

«Of course, it does not change the administrative structure of the UOC — everything remains as it is. But changing the perception of the UOC, at least, made such an attempt. In addition, it can help to avoid accusations of the Church in that its center is located in the «land of the aggressor», as specified in the bills Happy. It’s such a reasonable political step to avoid this,» said Lunkin.

In his opinion, these changes in the Charter contributed to the difficult situation of the Church in the country. While in fact «there is no evidence» that the Moscow Patriarchate had indeed interfered in the internal Affairs of the Ukrainian Church.

The Verkhovna Rada in mid-may it was planned to consider two resonant draft law on the status of religious organizations. The first of these suggests that religious organizations, senior centers are in the state recognized Ukraine «aggressor country» will be able to appoint metropolitans and bishops only in agreement with the authorities.

The second bill proposes to give the congregation the right to change the jurisdiction of the religious communities, the centers of which are in Ukraine and behind its limits. Deputy Chairman of the faction «Block of Petro Poroshenko» Alexey Goncharenko later said that the Parliament will not consider these bills as there is no required number of votes for their adoption.
