Petty-bourgeois court of Moscow on Tuesday rejected the complaint of the messenger Telegram, was fined 800 thousand rubles for refusing to provide the FSB with information to decode the message, the correspondent of RIA Novosti news from the courtroom.

«The decision in the administrative case remain unchanged» — announced the decision of the judge.

At this meeting, it turned out, for what was sentenced to a fine: according to the lawyer Dmitry Dinze, Telegram refused to provide the intelligence information to decode the correspondence of the accused in the case on the terrorist attack in St. Petersburg.

The decision to fine the messenger adopted the magistrate’s court number 383. In General, this article of the Administrative code envisages a fine of up to one million rubles, 800 thousand — the lowest possible punishment.

The lawyers explained in court that at the request of the FSB Telegram did not respond, considering it illegal and technically unenforceable. The representative of the FSB in court was not.

«Can’t be submitted to the decryption keys for the secret chats. They are generated on mobile devices and stored on them,» — said the lawyer Dmitry Dinze. Cloud-based chats you can decipher, but it is necessary to report precisely the time when the correspondence was conducted as part of the codes stored on servers in different countries, thus, it is necessary to organize interstate cooperation.

His colleague Ramil ahmetgaliev added that the employees had reason to doubt the legitimacy of the request of the FSB. «The company is in a foreign jurisdiction, the order of interaction in this case long-drawn — through the foreign Ministry or the Prosecutor General. And here — try this on yourself — the foreign law enforcement agencies send you a request to provide clues to the correspondence of users,» he said.

According to him, the company does not exclude cooperation, but must act according to the law — first received the court’s decision. «Essentially, it’s a requirement to write code decoding and provide it to the FSB,» — said the lawyer.

At the meeting it became clear that the reason for the fine was the failure of the messenger to decipher the correspondence of the brothers Asimovich accused on the case of explosion in the subway of St. Petersburg. According to the defendants, they used a different messenger, but the investigation is still requested Telegram.

The developers of the popular messenger regularly confronted with accusations by regulators in Russia and other countries. In late June, the Telegram was on the verge of locking in Russia after refusing to provide Roskomnadzor with information for inclusion in «the register of the organizers of information distribution». However, after public discussion, the Telegram still gave the required information — company registration (access to the correspondence users it was not).
