The Tver court of Moscow on Friday partially upheld the claim of the inhabitant of Rostov-on-don, who demanded that McDonald’s more than half a million rubles for spilled coffee on it and decided to charge the company 50 thousand rubles for moral damage, told RIA Novosti lawyer of the plaintiff Peter Dombrovitsky.

«The court decided in our favor… but the court ordered only 50 thousand moral harm and half for the services of a lawyer,» he said. Dombrovitsky added that part in respect of pecuniary damage, the court denied because it was not provided receipts for car repairs.

«Overall we are pleased with the decision,» he said. Thus in terms of the amount of compensation of moral harm the court’s decision likely will be appealed in Moscow city court protection, he said.

As previously reported Dombrovitsky, June 11 Nikolay Shestakov on the car stopped at one of the restaurants «Makavto» in Rostov-on-don, where he ordered a large coffee. The employee, according to his lawyer, handed him a glass, but accidentally knocked it. The doctors diagnosed men burns to the shoulder and chest. In addition, coffee is flooded the instrument panel in the car.

The man addressed in court with the claim in which demanded to compensate to it a material damage in the amount of 43 thousand rubles (diagnostic and auto repair), as well as moral compensation in the amount of 500 thousand rubles. The representative of McDonald’s asked the court to dismiss rostovchanina, insisting that the plaintiff himself was pouring himself a hot drink.
