Russian President Vladimir Putin signed a law facilitating the access of small and medium enterprises (SMEs) to the procurement by state-owned companies, state corporations and natural monopolies, should be published on the portal of legal information of the document.

The changes are aimed at improving the transparency of procurement entities covered by the law «On procurement of goods, works, services by separate types of legal entities», and to reduce their costs at the expense of wide introduction of technologies of electronic trading.

The document sets out an exhaustive list of methods of procurement, the ability of subsidiaries of customers to join the regulation on procurement of major societies, the right of the government of the Russian Federation to determine the required for customers, the value of procurement in electronic form.

The document introduces definitions of competitive and noncompetitive procurement procedures, establishes the requirements for conducting the closed competitive procurement and identifies the powers of the government to determine the procedure of closed procedures in electronic form and customers who will be required to conduct such procedures.

For the Federal Treasury fixed powers for management of the unified information system of the register of customers established by the government of the Russian order. The registry will allow the bidders to optimise the search orders, including taking into account the location of the participant procurement.

The requirements of the law on procurement by certain types of legal entities will not apply to transactions concluded by customers with their related persons, transactions related to conclusion and execution of contracts in accordance with the law on electricity, as well as transactions of legal entities registered in the territory of a foreign state.

State or municipal property should be sold on electronic platforms, the list of which will adopt the Russian government in accordance with the law «On contract system in procurement of goods, works, services for state and municipal needs». Thus, the unified list of electronic platforms for public procurement for procurement by legal entities.

Of SME Corporation entitled to appeal to the Federal Antimonopoly service of the owners and operators of the electronic platforms. Customers will be able to cancel the purchase (in whole or in one of the lots) until the date of expiry of submission of applications. Upon the expiration of such cancellation and prior to the conclusion of the contract the customer is entitled to cancel the provider definition only in case of force majeure.

The contract upon purchase is not earlier than 10 days and not later than 20 days from the date of placement in the unified information system of the final Protocol. The customer will be entitled to establish requirements to ensure the application in the case that the initial maximum contract price of more than 5 million rubles. The requirement to ensure that applications can not be more than 5% of the initial maximum price.

Procedures associated with participation in the auction, it will be easier and cheaper, including through electronic trading technology. Will be defined the concept of procurement in electronic form, there is a list of methods of procurement, systematic work of electronic platforms and simplified the reporting system of the customers.

The absence of a currently exhaustive list of competitive methods of procurement makes it difficult to exercise control in the area of procurement and preclude access to the procurement of subjects of small and medium enterprises, as difficult preparation of the procurement procedure.
