The question of the invalidation of the stamps in the passports of same-sex couples should be decided by the court, in this case there is a legal case, not an administrative offence or a disciplinary offence the employee of the centre, Signor, these stamps, told RIA Novosti the head of the presidential Council on human rights (HRC) Mikhail Fedotov.

Previously, the TV channel «Rain» reported that the multi-service center (IFC) in Moscow recognized the marriage between Eugene Voitsekhovsky and Paul Stocco which they made in Copenhagen on the 4th of January 2018. According to the head of the HRC, for the dismissal of an employee of the centre there is absolutely no reason because she acted in accordance with the instructions, and to accuse the citizens that they messed up the documents is also not the slightest reason, he added.

«Everything should be made exclusively according to the law. The Prosecutor in this case would have to go to court with a statement of acceptance of this legal action is invalid,» — said the human rights activist, noting that there are reasons for this.

In particular, the Russian Family code defines marriage as the Union of men and women, recalled the interlocutor of the Agency.

«Therefore, a marriage contracted abroad is valid in the territory of the Russian Federation, if this marriage is between a man and a woman, otherwise it is not marriage. In this case, an employee of the centre could not be a thin specialist in family law, and the court, quite obviously, could understand and put everything in its place», — said Fedotov.
