Ukraine’s constitutional court (CC) declared unconstitutional the law on principles of state language policy that grants Russian language regional status. This decision means that the law is abrogated. The Vice Prime Minister of Ukraine Vyacheslav Kyrylenko has called on to adopt a new document on the state status of the Ukrainian language.

According to UNIAN, the COP made the decision because of violation of the procedure of law adoption in the Parliament.

When interviewed by RIA Novosti experts believe that the decision of the COP focused on flirting with the radicals. Political analysts say that the abolition of this act deprives the rights of at least a third of the Ukrainian society.

The controversial law

In Ukraine in 2012 was adopted the law on principles of state language policy, which provided for the possibility of official use of the Russian language as a regional in 13 of 27 regions of the country. After a coup in Ukraine in 2014, the Verkhovna Rada invalidated the law in 2012, but that decision provoked unrest in the South and South-East of the country, and at that time the acting President Oleksandr Turchynov refused to sign the decision of Parliament. According to open sources, nearly three-quarters of the residents, in particular, the Donetsk region consider Russian their native language.

In 2014, 57 deputies appealed to the constitutional court concerning constitutionality of the language law. They believe that its regulations create the conditions for the dominance of the regional languages of the state.

President of Ukraine Petro Poroshenko said that the Ukrainian language must remain the only official language in the country, as, in his opinion, is a consolidating factor for companies.

The strengthening of the position of the Ukrainian language

Over the last four years in the Ukrainian Parliament there were several bills on the state language, which include the expansion of spheres of application of the Ukrainian language in the country. However, the documents were not submitted for voting as are controversial. On procedure, the draft laws are first considered at the Committee level.

One of these bills provides for exclusive use of the Ukrainian language in almost all spheres of life. It is sponsored by 33 deputies from different factions. It is envisaged that the Ukrainian language should be mandatory for all state power bodies and local self-government, preschool, school, out-of-school and higher educational institutions. In addition, it is assumed that the Ukrainian language should be used at all cultural events, in the service sector, and become a language of mass media and printing.

Vice Prime Minister of Ukraine Vyacheslav Kirilenko after the abolition of the law on fundamentals of language policy stated the need to adopt a new document on the state status of the Ukrainian language.

«The infamous law of Kolesnichenko-Kivalov cancelled a second time! Now the Constitutional court! No need to stop — now it is necessary to adopt a new law on the Ukrainian language, which finally implements the state status of the Ukrainian language, as provided for by the Constitution of Ukraine! It has to be done,» wrote Kirilenko in Twiter.

Flirting with the radicals

Co-author of the law, Verkhovna Rada Deputy Serhiy Kivalov is convinced that the constitutional court decision along with the applicable authorities.

«The court’s decision is overtly political. The argument of unconstitutionality is untenable. It should be clear that today the constitutional court of Ukraine, accompanying the current government and the «party of war», committed a serious political and not a legal act. Around the world have made clear that Ukraine does not want reconciliation, he wants to sow discord between the West and East of the country,» — said Kivalov RIA Novosti.

Director of the Ukrainian Institute of policy analysis and management Ruslan Bortnik believes that the abolition of the language law is purely political in nature. In his opinion, before the start of the election campaign, the Ukrainian authorities are trying to gain political points from the right-wing electorate.

«It’s obviously politically motivated decision. The government deploys election campaign. It’s like a fight for the electorate,» said Bortnik RIA Novosti.

The political scientist believes that the law was only a compromise model in the Ukrainian society.

«The law is absolutely correct, this is the only compromise model in the Ukrainian society. The abolition of the law denies the rights and guarantees at least a third of the Ukrainian society,» — said Bortnik.

The Bortnik believes that now the Ukrainian authorities to adopt a new law on the state language.

«The Parliament already has a number of such bills… However, any restriction can lead to exacerbation of the political within the society,» he said.

Ukrainian political analyst Alexander Rechmedilov also believes that «this decision will play into the hands of right-wing forces».

«It will enable them (the Ukrainian authorities) to once again flirt with his electorate… This decision is a trump card on the field, which will play right, right-wing and, maybe, center-right voters, for whom issues of language are extremely important,» — said RIA Novosti Rechmedilov.

The analyst also believes that soon the Ukrainian Parliament can pass a new law, which will strengthen the position of the Ukrainian language in the country.

«Perhaps the deputies of the Verkhovna Rada understand the precariousness of his position, because the probability of early parliamentary elections is quite large. This suggests that they can take all the unpopular last. The government can take right Bank, to flirt with this electorate by any means,» said Rechmedilov.

The DNI and the LC condemned the decision

The self-proclaimed Donetsk and Lugansk national Republic has condemned the decision of the Ukrainian authorities about recognition unconstitutional the law on the regional status of the Russian language in the country.

«The court’s decision is political and coincides with the state policy of Kiev in the prosecution and eradication of the entire Russian… the Next step will be increasing pressure on the Russian language and languages of national minorities and the adoption of the notorious law on the state language, establishing a language police and a criminal prosecution for incitement to bilingualism. Such actions are in the CL radicals and playing up their ideology,» said RIA Novosti the representative of the LC in the political subgroup Rodion Miroshnik.

The Chairman of the Committee on education, science and culture, member of the people’s Council DND Miroslav Rudenko also said that the decision of the constitutional court on «language» the law could be made under pressure of the radicals.

«Nationalist groups continue to dictate their terms, which violate the rights of local residents controlled by Ukrainian authorities territories. It is not excluded that the decision of the constitutional court of Ukraine on the law «On principles of state language policy» was adopted under pressure of the Ukrainian radicals», — told RIA Novosti Rudenko.

He noted that in the Donbass in 2014 spoke about the attempts of Ukrainian nationalists and radicals to restrict the right of Russian-speaking population to use their native language.

«Official Kiev at that time denied the existence of these processes at the state level in order not to increase the number of malcontents. The deception was simple — Ukraine is simply playing for time,» — said Rudenko.
