The state Duma Committee on defense on Thursday approved a bill which proposes to send recruits subpoenas by certified mail, and to release the police from the obligation to deliver citizens to the events associated with military service.

«The Committee passed the bill… and recommended the state Duma to consider in the first reading,» — said RIA Novosti, first Deputy Chairman of the Duma Committee on defense Andrei Krasov (EP), who authored the bill.

He added that the second reading is supposed to make the bill a number of amendments.

«The government generally supports the bill, but expressed as the legal Department of the state Duma apparatus, the observations on this bill, which we will try to resolve in the preparation of the bill a second reading, if it will chamber passed in the first reading,» — said the Deputy.

The initiative proposes using the same method of service of process (for painting), introduce also a new method of delivery — sending certified mail with return receipt requested to the address (place of residence or place of stay) stated in the documents of the military account of the citizen.

The document also proposed to establish that agenda, sent by mail shall be deemed delivered against receipt on the day of delivery registered letters to citizens, and adult members of their families or authorized representatives in the presence of the acknowledgment of receipt stamps postal organizations about delivery of a registered letter. In addition, it is proposed to establish that the failure to appear without good cause on the agenda of a military Commissariat on the actions connected with an appeal on military service, failure to appear in the military enlistment office to receive the agenda in specified circumstances or the failure to receive the agenda is considered evading military service and is punishable in accordance with the legislation of the Russian Federation.

The author of the project also notes that the powers of the police are only arresting persons suspected of committing crimes, persons wanted, persons in which relation is conducted manufacture on Affairs about administrative offences. In this regard, the functions of the internal Affairs bodies (police) for the production of such procedural action, as wanted, and delivered outside the framework of the criminal case or case on administrative offence does not corresponds to the norms of criminal procedural legislation and legislation on administrative offences. The proposed provisions of the bill eliminate this discrepancy, namely excluded under currently the responsibility of the internal Affairs bodies to ensure arrival of citizens to the events associated with military service.
