The state Duma adopted in the first reading a bill that establishes a single three-year term for registration of individual entrepreneur (SP), previously recognized as bankrupt.

The head of Committee on Affairs of public associations and religious organizations Sergey Gavrilov, presenting his initiative, drew attention that now the legislation establishes different terms (five years and one year) to register as self-employed people previously bankrupt.

In this regard, the relevant provision is almost never used, he said, «which greatly complicates and reduces the possibility of the rights of our citizens to work as IE». Therefore, the bill proposes to establish a single term of three years, not five, not a year, said Gavrilov.

The bill also provides that in the event of settlement agreement rule limiting the establishment of deadlines for the prohibition of conducting activities of the PI also will not apply, he continued.

In addition, the document allows to sign a notarial deed in presence of notary reinforced qualified electronic signature a simple electronic signature. For most transactions it will «reduce the time, expense of our fellow citizens, simplify transactions, as the notary and so establishes by law that the identity of the electronic digital signature», said Gavrilov.

The bill also obliges the notary after the approval of the contract on the alienation or mortgage of immovable property (his share) either immediately or in the time frames prescribed therein to submit an application for state registration of rights and the attached documents to the registering authority. «This will substantially protect, reduce fraud, reduce bad faith on a number of transactions and increase the accuracy of the actual information contained in the state registry of real estate», — believes the parliamentarian.
