The Association of retail companies (akort unites the largest Russian retail chains) requested an analysis of the impact of the bill on the prohibition of returns of products to the consumer market of Russia, the corresponding letter of the HSE to the speaker of the state Duma Vyacheslav Volodin signed by the Chairman of the Presidium of the Association, Sergei Belyakov available to RIA Novosti.

In January, the state Duma was introduced a bill prohibiting the return to suppliers of products that were not sold to retail chains for a certain period of time. Now trading networks and suppliers can enter into contracts providing for the possibility to return products if it is beneficial to both parties, but the law prohibited to impose the inclusion of conditions on the return.

Russian retailers opposed the ban, offering to resolve the contentious issues in relations with suppliers within the framework of self-regulation. A common position was not among the producers. The Russian Union of Industrialists and entrepreneurs (RSPP) indicated that the turnover of the largest Russian retail chains in the case of prohibition of return products may be reduced by hundreds of billions of rubles.

The Ministry of agriculture of the Russian Federation supported the adoption of the bill in the first reading, provided that it will be finalized by the second: for example, the Department proposes to approve the specific list of cases where the return of products is possible. The Ministry also advocated the revision of the draft law for the second reading in the lower house of Parliament.

According to information from the database of the state Duma, the Committee on agriculture recommended the bill during consideration in the first reading. It is scheduled for July 24.

Negative effects

In turn the HSE in its letter indicates that the consideration of the bill in the leading business associations, the participants noted «the inconsistency of the proposed ban on the return of foodstuffs with the provisions of the civil law, the diversity and the ambiguity of its impact on the economy of different categories of suppliers of food products».

«The negative consequences of the adoption of the bill marked not only trade, but also suppliers, which, according to surveys, more than 30% of small and medium suppliers of food products with short shelf life are currently used in practice returns the rotation and promotion of their products on the shelves of retail companies», — stated in the letter.

In addition, the Association refers to a preliminary assessment of the Business Council of the Eurasian economic Union (EEU), according to which the bill is in contradiction with several provisions of the Treaty establishing the Union and contains significant risks for the development of common integration space in the EEU.

«All the foregoing indicates that the provisions of the bill should be examined and evaluated in terms of their likely effect on the economic results of activity of participants of the food market: trade organisations and suppliers, in particular small and medium-sized businesses», adds the HSE.

Requires careful analysis

According to the Association of retailers, the bill for its impact on economic relations in the distribution network can have a serious negative impact on the volume of production of food products, as well as the range and prices of domestic food products. Therefore, HSE believes that the draft «is missing the urgent need for its rapid adoption in the spring session».

«Due to the high sensitivity of the food market to legislative regulation requires an in-depth qualitative research, identification and analysis of the impact of the bill on the economy of the consumer market of Russia. We ask you, dear Vyacheslav Viktorovich, consider the foregoing when reviewing the bill in the Council of the State Duma», — is letter.

The HSE confirmed to RIA Novosti the direction of this letter. «We advocate the adoption of quality crafted legislative initiatives. This approach contributes to the formation of the system of the legislative field,» — said Chairman of the Presidium of the Association, Sergei Belyakov.
