The Federation Council approved on Wednesday a law on the introduction of a new kind of disciplinary punishment of judges, the reduction in the qualifying class.

As reported at the meeting of the chamber the head of the Federation Council Committee on constitutional legislation Andrei Klishas, the law will contribute to improve the current procedure of disciplinary responsibility of judges. The reduction in the qualifying class will be used for material breach by the judge of the provisions of the law on the status of judges or the code of judicial ethics if the judge has previously been subjected to disciplinary action.

«The introduction of such additional disciplinary action, as the reduction in the qualifying class, will allow the qualification Collegium of judges to more accurately apply the measures of disciplinary liability against judges and to differentiate responsibility for the violations depending on the specific circumstances,» said Klishas.

In addition, the penalty of early termination of powers of judges will be imposed in exceptional cases for «substantial, incompatible with the high rank of judge» a violation of the provisions of substantive law or procedural law, law on status of judges or the code of judicial ethics in the administration of justice.

In addition, said Klishas, the law excludes the necessity of coordinating decisions of a qualification Collegium of judges on the recommendation of a candidate for the position of judge with the Chairperson of the respective court.
