Tele2 may appeal the warning of the FAS for the sms-mailing

LLC «T2 RTC holding» (mobile operator, Tele2) does not exclude the possibility of appeal against the warning of the Federal Antimonopoly service (FAS) regarding tariffs for sms for public and private organizations, told RIA Novosti press-service of the operator.

In mid-June, the FAS has given out to the operators of the «big four» (MTS, MegaFon, VimpelCom and Tele2) prevention, which for 14 days were to eliminate the discriminatory terms of contracts to sms for public and private organizations. On Monday, the FAS announced that it has initiated proceedings against operators. According to the Agency, the terms of contracts with organizations without state participation in the capital differ significantly from the terms of contracts of state-owned organizations.

Tele2 can appeal the warning of the FAS. «The terms of contracts with Tele2 organizations without state participation in the authorized capital do not contain discriminatory conditions. We are considering the possibility to appeal against this warning,» — said the press service of the company.

Earlier «the Megaphone» has declared that its prices on bulk sms are market-oriented. The company also noted that sms is not the only way to inform consumers, and that «the Megaphone» does not occupy a dominant position in this market. In «the Megaphone» also has added that the law does not reglamentary way of informing banks and their customers can choose any of them. In MTS and «Vympelcom» have refrained from comments.

In late December, the FAS received a complaint from the National Council of financial market (NSFR) in connection with the increase in the price of sms to the customers. Later in February, following the meeting of the Interregional banking Council under the Federation Council it was decided to instruct the FAS to conduct an investigation into the sharp rise in the cost of bulk sms for banks and communication operators. Initially it was assumed that the investigation against four mobile operators (MTS, «VimpelCom», «MegaFon» and Tele2) must be completed by March 20, but it was extended indefinitely. FAS June 5 reported that the test is over.
