The signing of the agreement with Russia on cooperation in the Azov sea in 2003 Ukraine became a formal defeat. About this in a joint article for the edition «Mirror of week» wrote Deputy foreign Minister for European integration Olena zerkal and Advisor to the Minister Kachka.

The authors generally praised the agreement as a failure for Ukraine and drew attention to the paragraph that defines the sea of Azov and the Kerch Strait is internal waters of Russia and Ukraine. They argue that Moscow «has achieved its goal after a blatant threat of force» during the conflict over the ownership of Tuzla island in the Kerch Strait.

«Was it the defeat of Ukraine? Formally — Yes», — stated in the material.

According to Jocks and mirrors, Russia entered into this agreement in order to «leave everything as it was in the days of the Soviet Union.» Thus, according to Ukrainian diplomats, the concept of internal waters themselves have not realized. The only working element remains freedom of navigation for Russian and Ukrainian vessels in the waters of the sea of Azov, they emphasize.

«All other sovereign rights remains individual, and each party to implement them in their part of the Azov. And international-legal base for realization of these rights was the UN Convention on the law of the sea. That is, «inland waters of the two States» and General sovereignty of the two States in the waters of the sea of Azov never as such was not» — says the article.

The agreement on cooperation in the Azov sea was signed by the presidents of Russia and Ukraine Vladimir Putin and Leonid Kuchma in December 2003. The document contains five articles. In addition to the regulations on the status of waters, it says that the Azov sea is divided by the line of the state border, approved the freedom of navigation of commercial, military and government vessels under the flags of Russia and Ukraine, allowed the passage of ships of third countries at the invitation or permission of one of the parties, and emphasizes that disputes between the parties shall be resolved through consultations and negotiations between them.

Earlier Olena zerkal said that Kiev is not going to break or renew this agreement.

Ukraine accuses Russia of blocking cruise ship arrivals, which follow in the Ukrainian ports across the Kerch Strait, which ships idle, and their owners suffer losses. At the same time claims to the Russian border guards on the observance of protocols of inspection of these vessels no.

In the Crimean border guard service reported that all audits are conducted in accordance with international law of the sea, comments from shipowners has not been received.
