Deputy Chairman of Moscow city court Dmitry Fomin believes that in the Metropolitan detention center contains only those prisoners «who deserve it», and this figure will always be great because of the specificity of Moscow.

«It is impossible not to take into account the specifics of the Moscow region. We have a huge number of people who have nothing to do with Moscow and the Moscow region come here for employment or other reasons to commit crimes. Such people in our detention centres contains about 60%», — he said in an interview with the journal «criminal procedure».

According to him, if a man «committed a petty theft, the court does not take him into custody,» since the law to elect a preventive measure for minor offenses.

«But we understand that there are, for example, professional criminals, say pickpockets. It would seem that the crime, which he commits under part 2 of article 158 of the criminal code, is classified as moderate. How the court to do in this case? «Or, for example, a typical robbery: the visitor took a woman’s purse without violence and ran away. Again, a misdemeanor. Or, say, petty drug mule from Central Asia. He believes that the courts «have reached a reasonable limit, when in the detention centers of Moscow, are only those who deserve it».

«And Yes, for Moscow this number is always large. Most importantly in this case, the fact that the remand centres should be provided with appropriate conditions. But this issue is within the exclusive competence of the Federal penitentiary service,» said Fomin.
