The idea to create an expert body to determine the presence of extremism in one way or another to information posted on the Internet, a good, but ideally there need not experts, but just a sensible users of the network, the head of the presidential Council on human rights (HRC) Mikhail Fedotov.

Russian President Vladimir Putin on Wednesday submitted to the state Duma the project, partly decriminalize 282-th article of the Criminal code on extremism. According to the explanatory Memorandum, it will be impossible to initiate a criminal case against people for the first time in conflict with the law, provided that their conduct «did not pose a serious threat to the constitutional order and security of the state». It is expected that criminal liability will result if the violation occurred more than once during the year. Press Secretary of the President Dmitry Peskov noted that so far has no information about the possibility of Amnesty for those convicted under article 282.

On Friday in a speech at the round table devoted to the upcoming changes in legislation, technical Director Mail.Ru Group Vladimir Gabrielyan stated the need for more qualified examination of the cases of extremism. In his opinion, it is important to form an expert body, which could go along with the OP members, human rights activists and experts, determining the presence of extremism in one way or another information.

«Not a bad idea about to create a kind of Advisory Council…. But I have looked at this problem from the other side. Maybe it’s too radical, maybe I was too forward — but in actual fact, what should be examination in cases of incitement to hatred? Because the text that is placed in the network to incite hatred aimed at whom? Target audience: experts or ordinary users? You just ask five ordinary users: here you read this text, you have it stirred up the hatred? Filed — all, so this is extremism. Not filed? Then laughed and went on,» — said Fedotov.

«Here don’t need an expert, you just need people with common sense. But at least let’s start with the expert Council,» he added.

As noted by Fedotov, there is every reason to believe that the presidential initiative will lead to the fact that the tendency to increase the number of persons convicted for extremism in the Internet will stop. «We caught the situation at the peak, the number of cases on the 282-th article of part 1 grew at a very strong pace,» he said.

The head of the HRC considers that it would be possible also to remove them the text of the law, «references to social groups» and the mention associated with humiliation. «Humiliation is an insult, it is a separate administrative offense», — he explained.

According to statistics of the Prosecutor General of the Russian Federation, «lion’s share» of criminal cases on extremism in Russia make it for various publications on the Internet. So, last year, from a pool of cases on this article 75% related to the network.
