According to the Constitution of Ukraine, the Verkhovna Rada has no authority on the transfer of objects of state property in use, therefore, the Parliament decision on the transfer of St. Andrew’s Church of Constantinople Patriarchate illegally, the leader of movement «the Ukrainian choice — the Right of the people» Viktor Medvedchuk.

«This decision is a legal act of individual character and cannot be the subject of legislative regulation, since the law defines the order of social relations in the state, not private property issues. Transfer to the use to anyone of objects of state ownership does not belong to the authority of Parliament, enshrined in the Constitution of Ukraine. Management of objects of state ownership is the prerogative of the Cabinet of Ministers» — quoted Medvedchuk’s press service on the page in Facebook.

On Thursday, the Ukrainian Parliament at the second attempt adopted the law on the transfer of St. Andrew’s Church for permanent use of the Constantinople Patriarchate. Representatives of faction «Opposition bloc» announced that he had filed a document on the abolition of this decision. Thus the signing of the resolution by the speaker of the Verkhovna Rada and President of Ukraine should be blocked while the document did not address the Parliament. Despite this, the speaker of Parliament Andriy Parubiy gave the law to the President for signature. While Ukrainian President Petro Poroshenko believes that the transfer of the Church will accelerate the granting of autocephaly.

St. Andrew’s Church in Kiev — the Orthodox Church in honour of St. Andrew, built in the Baroque style by the architect Bartolomeo Rastrelli in 1754, on St. Andrew’s hill. It is located on the right Bank of the Dnieper, above the historical part of Ukrainian capital — Hem. Until 2015 St. Andrew’s Church was subordinated to the Ukrainian non-canonical structure. Then the lease ended and the building started to reconstruct. Now the Church finds in the state.

The President of Ukraine is trying to achieve recognition of non-canonical religious structures and creation on their basis one local Autocephalous Church in Ukraine, outside the framework of the Ukrainian Orthodox Church. The head of the Department for external Church relations (DECR) of the Moscow Patriarchate Metropolitan Hilarion of Volokolamsk said earlier that because of autocephaly may be deprived of property of the canonical UOC.

Because of the decision of Constantinople to begin providing non-canonical autocephaly churches in Ukraine, which the Russian Orthodox Church is called the schism, the Synod of the Russian Orthodox Church on Monday announced the severance of communication with the Patriarchate of Constantinople on the canonical territory of the ROC, including Ukraine and Belarus. The Holy Synod of the Russian Orthodox Church has called canonically void, and saw politics in the abolition of Constantinople by the act of 1686 on the transfer of the Kyiv Metropolitanate to the jurisdiction of the Moscow Patriarchate.

The head of the Department for external Church relations of the Moscow Patriarchate, Metropolitan Hilarion said that Constantinople lost its right to be called the coordinating centre of Orthodoxy.
