The state Duma Committee on financial market recommended the lower chamber of Parliament to reject in the first reading a bill aimed at limiting the interactions of the debtor and the collector in the return of arrears.

The document, introduced by deputies from LDPR led by Vladimir Zhirinovsky, was developed in order to clarify the grounds for bringing the lender collectors to debt collection, as well as to protect debtors and third parties, when it is returned.

Against the adoption of the draft law by the government of the Russian Federation, noting that the document, in particular, to limit the possibility of assignment of creditor’s rights (claims) under the agreement of a consumer loan (loan) only in respect of arrears. However, the legislation of the Russian Federation does not establish restrictions on the assignment of rights (claims) under such contract depending on the availability at the debtor of the overdue debt, reminiscent of the Cabinet.

Now the creditor or that it attracts the collector is entitled to communicate with the debtor through personal meetings, telephone conversations, Telegraph and other communications, mail. Other ways of interaction possible with the written consent of the debtor. The bill proposes to exclude the possibility of these other ways of interaction with the debtor, retaining only those that are explicitly stated in the law.

However, these «other ways» of interaction are complementary, are an additional tool for selecting the best order of interaction within the overdue debt, the use of which the debtor is entitled at any time to opt-out noted in the government response to the bill.

Moreover, there is no justification for excluding from the law «On consumer credit (loan)» provisions to protect the banking and other secrets protected by law, as well as personal data of citizens, said the Cabinet.
