The Deputy of the state Duma Natalia Poklonskaya sent to the Turkish Ambassador to the Russian Federation Hussein Dirioz legal opinion on the decision of Constantinople to begin the granting of autocephaly of the non-canonical Church in Ukraine. The initiative group of legal scholars headed by doctor of legal Sciences by Igor Poncini convinced that such actions of Constantinople can be regarded as violation of the legislation of Turkey, as the residence of Patriarch Bartholomew I is located in Istanbul.

«I have received a legal opinion, prepared by the initiative group headed by doctor of legal Sciences by Igor Poncini regarding the content and validity adopted by the Holy Synod of the Patriarchate of Constantinople on 11 October 2018, the act of recognition become invalid for the decision of the Patriarchate of Constantinople from 1686, which Kiev Metropolitanate was legally transferred to the jurisdiction of the Moscow Patriarchate. In the conclusion of the legal defect of the act in 2018, and the only act of 1686. In addition, the actions of Patriarch Bartholomew I is analyzed from the point of view of compliance with the Turkish legislation,» said Poklonskaya RIA Novosti.

According to the MP, the document notes that the actions of Patriarch Bartholomew I violate articles of the Turkish Constitution, law of Turkish «associations» are covered under signs of crimes under article 216 of the Turkish Penal code «Incitement of hatred or enmity, or humiliation of human dignity», articles 304 and 219 of the criminal code of Turkey in terms of encroachment of religious services on the security of the country.

«In connection with the above specified legal opinion sent me to the Ambassador of Turkish Republic in Russian Federation Mr. Hussein Dirioz for transmission to the Prosecutor, interior Minister and the chief Ombudsman of Turkey. I hope that these officials will not disregard this document and take response actions in accordance with their competence», — concluded the MP.

Because of the decision of Constantinople to begin providing non-canonical autocephaly churches in Ukraine, which the Russian Orthodox Church is called the schism, the Synod of the Russian Orthodox Church on 15 October announced the severance of communication with the Patriarchate of Constantinople on the canonical territory of the ROC, including Ukraine and Belarus.

The Holy Synod of the Russian Orthodox Church has called canonically void, and saw politics in the abolition of Constantinople by the act of 1686 on the transfer of the Kyiv Metropolitanate to the jurisdiction of the Moscow Patriarchate. Metropolitan Hilarion said that Constantinople lost its right to be called the coordinating centre of Orthodoxy. In the Russian Orthodox Church hope that Constantinople will change the decision to give the autocephaly of the Ukrainian Church, and before that he will be in schism.
