The Tokyo Prosecutor’s office is considering a case against the automaker Nissan as a legal entity in connection with the fraud suspected by the Chairman of the Board of Directors of the company, Carlos Ghosn, who was arrested on Monday, told the newspaper the Asahi, citing sources.

The basis for the institution of separate proceedings against the Nissan group may be the resolution on «punishment of both parties» in connection with the fact that rut for a long time did not indicate the portion of their income and this occurred with the active participation of senior employees of the company.

The publication sheds light on the essence that preceded the arrest of the Rut. Earlier it was reported that the head of the Board of Directors purchased the property in Paris, Beirut, Rio de Janeiro and Amsterdam with company money. These acquisitions were not due to official or commercial necessity – the property was in the use of Gon and his family. The purchase and construction of apartments Nissan is estimated at several billion yen (several tens of millions of dollars). The company considered that in this case, the gon was required to specify them in the Declaration of income, as used company funds for their own purposes.

The group has provided this information to the Prosecutor. The acquisition of real estate took place with the direct participation of a member of the Board of Directors, the right hand of Gon — Greg Kelly. He gave orders to the Executive Directors on the transaction as the purchase of apartments on the corporate media. The Prosecutor’s office was able to negotiate with several of them that they will be made concessions in the case of the provision of information and cooperation with the investigation.

On Monday, Nissan confirmed that the head of the Board of Directors Carlos Ghosn for many years underestimated data on personal income. The Department of special investigations of the Tokyo prosecutors arrested him on suspicion of violations of financial laws of the country. Ghosn, who is also CEO of Renault, suspected that from 2010 to 2015 hid almost half the amount of their income — about 5 billion yen (about $ 44 million).
