The reduction of requirements for the compulsory share of malt in the beer will not solve the problem of «legal counterfeiting» in this market, because the new rules do not introduce new methods to control the execution of even these reduced requirements, told RIA Novosti press-service of Roskoshestvo.

The Board of the Eurasian economic Commission in November approved the draft of technical regulations of the Eurasian economic Union on safety of alcoholic products. The document, in particular, introduces a number of definitions of alcoholic beverages, e.g., beer. In the draft of the technical regulations says that the production of the drink allowed partial replacement of brewing malt grain or its products, if their total weight does not exceed 50% of the weight of the replaceable malt, and the weight of sugar-containing products — no more than 5% of the mass of malt, grain and grain products.

Thus, according to the Russian law on regulation of production and turnover of alcohol in beer production allowed partial replacement of brewing malt grain, products of its processing or sugar-containing products if their total weight does not exceed 20% of the weight of the replaceable malt, and the weight of sugar-containing products does not exceed 2% of the mass model of the brewer’s malt.

«The proposed reduction of requirements for the compulsory share of malt in the Russian products do not eliminate the «legal gap», which is actually today allows you to legally produce and sell beer products with any quantity of malt», — said in Roccacasale. «The new legislation establishes a more liberal requirements for the product, but does not introduce new methods to control the execution of even these reduced requirements. Therefore, any changes in the number and quality of malt does not solve the problem of so-called «legal counterfeiting,» added the organization.

Roskoshestvo also notes that currently the mandatory content of beer at least 80% of malt, however there are no certified methods for the identification of beer and beer drinks, namely methods for determining the quantitative content of malt, unmalted raw materials, sugar-containing products.

«These are unscrupulous manufacturers, implementing under the guise of beer and beer drinks. The current situation does not allow to monitor compliance with legislative requirements for the composition of beer, to bring to justice unscrupulous manufacturers resulting in the loss of tax revenues. After the entry into force of the new technical regulation without the simultaneous approval of methods of control also it will be impossible to monitor compliance with its requirements,» — said in Roccacasale.
